Your use of the worldclassvanilla.com web site (the “Site”) is governed by the policies, terms, and conditions set forth below. Please read the following information carefully. By using this Site or submitting an order for products or services, you indicate your acceptance of, and agreement to be bound by, the terms and conditions set forth below. If you do not agree to these terms and conditions, please do not use this Site and please do not submit any orders for products or services.

These terms and conditions may be changed by World Class Vanilla Co. in the future. It is your responsibility as a user to periodically return to this page to review the terms and conditions for amendments. The amended terms shall take effect automatically the day they are posted on the site. Your continued use of the worldclassvanilla.com web site following any amendments will constitute agreement to such amendments. These Terms of Service were last revised on July 15, 2013.

Payment Options: We accept Visa, Master Card, Discover, American Express, PayPal, and company purchase orders on approved credit. Please contact us for credit approval at sales@worldclassvanilla.com. We will not charge your credit card for an item(s) until it is shipped. Credit card orders shipped to a location other than your billing address may require additional verification. See Payment Section regarding Tax Requirements. All prices on the worldclassvanilla.com site are quoted in U.S. currency and all orders must be transacted in the same.

Prices & Availability: Because many of our products are international commodities, prices and availability are subject to change without notice. If a product is not in stock when you place your order (for example, not yet available or sold out), we will do our best to let you know and to let you know when we anticipate the product will be available. Anticipated delivery dates are dependent upon vendor supplies and other factors and are subject to change.


Unauthorized or Refused Returns: World Class Vanilla Co. will not accept unauthorized returns or exchanges. Packages without a Return Authorization Number will be refused upon return to our warehouse. World Class Vanilla Co. will impose a 15% restocking fee plus any applicable shipping and handling charges for refused shipments by the customer. Additional charges may apply if the merchandise is not returned in 100% complete condition in the original, unopened packaging. To complete a return, you must contact World Class Vanilla Co. customer service at (888) 578-8870 to obtain an RA (Return Authorization) number before returning your product to World Class Vanilla Co. For faster service, please have the following information ready when contacting us for an RA number: Customer name, order number, date of receipt, item number and the reason for return.

Defective Returns: Defective returns will be accepted for exchange or refund within 30 days from the shipment date. No refunds or credit will be granted after 30 days from the date of shipment. 

Typographic, Photographic & Technical Errors: Although we do our best to achieve 100% accuracy, occasionally errors & inaccuracies do occur. Should you encounter an error or inaccuracy, please inform us so it can be corrected. Products & packaging depicted may differ from stock available at time of shipment. We reserve the right to substitute equivalent items.

Warranty Disclaimer and Limitations on Liability: WORLD CLASS VANILLA CO. DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

WORLD CLASS VANILLA CO. SHALL UNDER NO CIRCUMSTANCES BE LIABLE FOR SPECIAL, INCIDENTAL, CONSEQUENTIAL (INCLUDING LOST PROFITS OR OPPORTUNITIES) OR PUNITIVE DAMAGES, EVEN IF IT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE MAXIMUM LIABILITY OF WORLD CLASS VANILLA CO. FOR ALL DAMAGES SHALL BE LIMITED TO AN AMOUNT NOT TO EXCEED THE PURCHASE PRICE OF THE PRODUCT. LIKEWISE, WORLD CLASS VANILLA CO. WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF ITS WEB SITE, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE AND CONSEQUENTIAL DAMAGES. ALL MERCHANDISE IS SOLD "AS IS". WORLD CLASS VANILLA CO. MAKES NO WARRANTY AS TO THE PERFORMANCE OF ANY MERCHANDISE SOLD. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS AND REMEDIES THAT VARY FROM STATE TO STATE.

Disputes: Any claims against World Class Vanilla Co. relating in any way to your purchases from World Class Vanilla Co. shall be submitted to confidential arbitration in Monmouth County, New Jersey. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrators award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise. In any such arbitration, the parties shall be responsible for their own costs, expenses and attorney’s fees. In the event that this arbitration provision is unenforceable, any litigation regarding this agreement or any transaction between the customer and World Class Vanilla Co. shall be brought in the state or federal courts located in Monmouth County, New Jersey, and the customer hereby agrees and submits to such jurisdiction and venue as exclusive and proper.

Governing Law: Transactions between you and World Class Vanilla Co., and any disputes arising between you and World Class Vanilla Co. related to any interaction between you and World Class Vanilla Co., including but not limited to claims relating to the content of its Web site, shall be governed by and construed in accordance with the laws of the State of New Jersey without regard to the laws regarding conflicts of law. If any provision of this agreement shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.

Title - Risk of Loss: Title to items being purchased passes from World Class Vanilla Co. to purchaser at the time of shipping. Customer takes on full liability for safety and validity of delivery address given to us at the time of purchase. World Class Vanilla Co. will not incur any forwarding costs on shipments. World Class Vanilla Co. shall not be responsible for damages or delays resulting from Acts of God, war, riot, seizure, terrorist activities, embargo or other acts or events outside of the reasonable control of World Class Vanilla Co.

Return Procedures:  Any product returned will be credited the lower of the purchase price or current price. No return will be accepted without a return authorization (RA) number. To request a RA number, please contact a World Class Vanilla Co. associate at: (888) 578-8870, or via email at: sales@worldclassvanilla.com. RA numbers are valid for ten business days after issue. Your RA number(s) must appear clearly on the shipping label of the return shipment.  PLEASE DO NOT MARK THE PRODUCT PACKAGING ITSELF IN ANY WAY. In the case of any product(s) returned for any reason, the returned item(s) must be 100% complete, in original and re-salable condition, with all packaging. We reserve the right to refuse a return on any product that does not meet these requirements. Shipping and Handling Fees are not refundable, with the exception of orders incorrectly shipped by World Class Vanilla Co.

Additional Information: World Class Vanilla Co. policies are subject to change without notice. We do our best to ship all orders as rapidly and accurately as possible. However, World Class Vanilla Co. is not liable for late or delayed shipments or system failures. Title to items being purchased passes from World Class Vanilla Co. to purchaser at the time of shipping. If you purchase items for export, you must obtain from the Federal government certain export documentation.

Making Purchases

If you wish to make purchases of products or services described on the Site, you will be asked to supply certain information, including but not limited to credit card or other payment information. You agree that all information that you provide to World Class Vanilla Co. will be accurate, complete and current. You agree to pay all charges incurred by authorized users of your account and credit card or other payment mechanism at the prices in effect when such charges are incurred. You will also be responsible for paying any applicable taxes, and shipping, handling, and processing charges relating to your purchases.

Pricing and Typographical Errors

We make every effort to provide you the most accurate, up-to-the-minute information. Despite our best efforts, a small number of the items on our web site may be mis-priced.

In the event a product is listed at an incorrect price due to typographical, photographic, or technical error or error in pricing information received from our suppliers, World Class Vanilla Co. shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. 

  • If an item's correct price is lower than our stated price, we will charge the lower amount and ship you the item. 
  • If an item's correct price is higher than our stated price, we will cancel your order and notify you of the price error and order cancellation. You will, of course, have an opportunity to purchase the item at the correct price, if you so wish.



While we make every attempt to verify prices before charging your credit card, World Class Vanilla Co. shall have the right to refuse or cancel any orders placed on mis-priced product whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, World Class Vanilla Co. shall immediately issue a credit to your credit card account in the amount of the incorrect price.

We believe that day-in, day-out, our pricing is very attractive relative to our competition. Combined with our product assortment, product availability and service level, we believe that we offer a compelling shopping experience. With that in mind, we do not "match" competitor's pricing, or offer price protection.

Disclaimer and Limitation of Liability

DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF ANY PRODUCT PURCHASED IN TERMS OF ITS COMPATIBILITY, CORRECTNESS, ACCURACY, RELIABILITY OR OTHERWISE. AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SPONSORS, CONSULTANTS OR OTHER REPRESENTATIVES (“SERVICE PROVIDERS”) SHALL NOT BE RESPONSIBLE OR LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE OR OTHER DAMAGES (INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, LOSS OR CORRUPTION OF DATA, LOSS OF GOODWILL. IF THE FOREGOING LIMITATION IS HELD TO BE UNENFORCEABLE, THE MAXIMUM LIABILITY OF WORLD CLASS VANILLA CO. SHALL NOT EXCEED THE AMOUNT OF FEES PAID BY YOU FOR THE PRODUCTS YOU HAVE ORDERED THROUGH THE SITE. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN DAMAGES, SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU TO THE EXTENT SUCH JURISDICTION’S LAW IS APPLICABLE TO THIS AGREEMENT.

A possibility exists that the Site could include inaccuracies or errors. Additionally, a possibility exists that unauthorized additions, deletions and alterations could be made by third parties to the Site. Although WORLD CLASS VANILLA CO. attempts to ensure the integrity of the Site, it makes no guarantees whatsoever as to its completeness, correctness, or accuracy. In the event that such an inaccuracy arises, please inform WORLD CLASS VANILLA CO. so that it can be corrected.

Price and availability of products offered on the Site are subject to change without prior notice. To the extent we provide information on availability of products, you should not rely on such information. WORLD CLASS VANILLA CO. will not be liable for any lack of availability of products and services you may order through the Site.

Purchase for Export:  If you purchase items for the purpose of export, you must obtain from the federal government certain export documentation, and that responsibility is solely yours.

If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions. This agreement constitutes the entire agreement between the parties relating to the subject matter herein and cannot be modified except in a written agreement signed by both parties. Any heading, caption, or paragraph title contained in this Agreement is inserted only as a matter of convenience and in no way defines or explains any paragraph or provision hereof.

Applicable Taxes

Any sales, use or other applicable tax is based on the location to which the order is shipped. If you believe your purchases are not subject to sales tax, please contact us at sales@worldclassvanilla.com, prior to placing an order.

Seller does not collect sales or use tax in a number of states, including without limit, the states of Oklahoma, Vermont and South Dakota; your purchases may be subject to state and local taxes even though we may not collect such taxes; your purchases are not tax exempt solely because they are made over the internet or via catalog; your ship-to state may require all non-taxed purchases to be reported (for example the states of Oklahoma, Vermont and South Dakota require a customer in these states to report such non-taxed internet or catalog purchases and to pay applicable taxes on such purchases); sales and use taxes are your responsibility; please contact your ship-to states’ taxing authority for tax forms and reporting procedures that may be applicable to your taxable purchases.

Mandatory Arbitration Mandatory Arbitration. THIS SITE, OR THE PURCHASE OR SALE OF ANY PRODUCTS OR SERVICES, WILL BE RESOLVED BY FINAL, BINDING ARBITRATION, INSTEAD OF IN COURT, except that (a) you may take claims to small claims court, if they qualify for hearing by such court, and (b) if you fail to timely pay amounts due, we may assign your account for collection and the collection agency may pursue such claims in court limited strictly to the collection of the past due debt and any interest or cost of collection permitted by law or the Agreement. This agreement to arbitrate extends to claims that you assert against other parties, if you also assert claims against us in the same proceeding. THERE IS NO JUDGE OR JURY IN ARBITRATION, AND COURT REVIEW OF AN ARBITRATION AWARD IS LIMITED.

For all disputes, you must first send a written description of your claim to our Customer Service department. You can contact our Customer Service department by email (sales@worldclassvanilla.com) or U.S. Mail (World Class Vanilla Co., 602 Higgins Ave., Ste. 303, Brielle, NJ 08730). We each agree to negotiate in good faith to settle your claim or dispute. If we do not reach agreement within 30 days, you may pursue your claim in arbitration, or in small claims court as described above. To pursue your claim in arbitration, you must contact us for the name and mailing address of our registered agent. You will pay your share of the arbitrator’s fees except: (a) for claims less than $25, we will pay all arbitrators’ fees; and (b) for claims between $25 and $1,000, you will pay $25 for the arbitrator’s fee. You and we agree to pay our own other fees, costs, and expenses including those for counsel, experts, and witnesses. You and we agree that this Agreement involves interstate commerce and, despite the choice of law provision in Paragraph 21, the Federal Arbitration Act and federal arbitration law govern arbitrations under the Agreement. An arbitrator may only award as much relief as a court having jurisdiction in the place of the arbitration, limited to the same extent that a court would limit such relief and consistent with the provisions of the Agreement, including the limitation of liability in Paragraph 18. An arbitrator may order injunctive or declaratory relief (so long as that injunctive or declaratory relief does not apply beyond your dealings with us) or summary judgment under applicable law. An arbitrator may not award relief in excess of or contrary to what this Agreement provides, except that the arbitrator may award on an individual basis damages required by statute and may order injunctive or declaratory relief pursuant to an applicable consumer protection statute.

CLASS ACTION WAIVER. YOU AND WE ACKNOWLEDGE AND AGREE THAT WE EACH WAIVE ANY RIGHT TO PARTICIPATION AS A PLAINTIFF OR AS A CLASS MEMBER IN A CLASS ACTION. Neither you nor we may be a representative of other potential claimants or a class of potential claimants in any dispute, nor may two or more individuals’ disputes be consolidated or otherwise determined in one proceeding. This class action waiver applies if you bring your claim in arbitration and if you bring your claim in small claims court. IF A COURT OR ARBITRATOR DETERMINES THAT YOUR WAIVER OF YOUR ABILITY TO PURSUE CLASS OR REPRESENTATIVE CLAIMS IS UNENFORCEABLE, THE ARBITRATION AGREEMENT WILL NOT APPLY AND OUR DISPUTE WILL BE RESOLVED BY A COURT OF APPROPRIATE JURISDICTION OTHER THAN A SMALL CLAIMS COURT. SHOULD ANY OTHER PROVISION OF THIS ARBITRATION AGREEMENT BE DEEMED UNENFORCEABLE, THAT PROVISION SHALL BE REMOVED, AND THE AGREEMENT SHALL OTHERWISE REMAIN BINDING.

JURY TRIAL WAIVER. YOU AND WE ACKNOWLDGE AND AGREE THAT, if a claim proceeds in court rather than through arbitration, WE EACH WAIVE ANY RIGHT TO A JURY TRIAL.
